DMCA & Copyright Policy

Dynamanic LLC respects the intellectual property rights of others and expects users of Railfans Live and its regional subdomains (collectively, the “Service”) to do the same. This policy explains how copyright owners can notify us of allegedly infringing material on the Service, and how users may submit counter-notifications, under the U.S. Digital Millennium Copyright Act, 17 U.S.C. § 512 (the “DMCA”).

1. Designated Copyright Agent

The agent above is also registered with the U.S. Copyright Office DMCA Designated Agent Directory. Notices not sent to the designated agent may not receive a timely response.

2. Filing a Notice of Claimed Infringement

To be effective under the DMCA, a notification must be a written communication to our designated agent that includes substantially the following:

  • a physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  • identification of the copyrighted work claimed to have been infringed (or, if multiple works at a single online site are covered by a single notification, a representative list of such works);
  • identification of the material claimed to be infringing or to be the subject of infringing activity, with information reasonably sufficient to permit us to locate the material (URLs, sighting IDs, photo IDs, or video IDs are ideal);
  • information reasonably sufficient to permit us to contact you, including a postal address, telephone number, and email address;
  • a statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
  • a statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Misrepresentations in a takedown notice may subject you to liability under 17 U.S.C. § 512(f).

3. Our Response

When we receive a compliant notice, we will (a) promptly remove or disable access to the material, (b) take reasonable steps to notify the user who posted the material, and (c) record the takedown for repeat-infringer tracking. We may also forward your notice (with personal contact information) to the affected user.

4. Counter-Notification

If you believe material you posted was removed or disabled by mistake or misidentification, you may submit a counter-notification to our designated agent containing substantially the following:

  • your physical or electronic signature;
  • identification of the material that was removed or disabled, and the location at which it appeared before removal;
  • a statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification;
  • your name, postal address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, for any judicial district in which we may be found), and that you will accept service of process from the person who provided the original notification or an agent of that person.

We may, but are not required to, restore the material between 10 and 14 business days after we forward the counter-notification to the original complainant, unless the complainant first notifies us that they have filed an action seeking a court order to restrain further infringement.

5. Repeat Infringer Policy

In appropriate circumstances, we will terminate accounts of users who are repeat infringers. We track DMCA notices per account and weigh factors such as the volume of valid notices, severity, and whether counter-notifications were filed and sustained.

6. Reservations and Other Rights

This policy describes our DMCA process; it does not limit our ability to remove content under our Terms of Service or Acceptable Use Policy for independent reasons.
