Terms of Service

1. Acceptance
These Terms of Service (the “Terms”) govern your access to and use of Railfans Live and its regional subdomains (collectively, the “Service”), operated by Dynamanic LLC (“we,” “us,” “our”). By creating an account, signing in, or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy.
2. Eligibility
You must be at least 13 years old to create an account. If you are under 18 (or the age of majority in your jurisdiction), you may only use the Service with the consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf. We may require age verification.
3. Your Account
You are responsible for maintaining the confidentiality of your sign-in credentials and for all activity that occurs under your account. Notify us immediately at the contact address below if you suspect unauthorized access.
4. User Content
The Service lets you submit photos, videos, sighting notes, location information, locomotive identifiers, comments, and similar materials (“User Content”). You retain all rights you have in your User Content. By submitting User Content, you grant Dynamanic LLC a worldwide, royalty-free, non-exclusive, sublicensable license to host, store, reproduce, display, distribute, and create derivative works of your User Content for the purpose of operating, promoting, and improving the Service, including across all current and future regional subdomains.
You represent and warrant that you own or have all rights necessary to grant this license, and that your User Content does not violate any third-party rights or applicable law.
5. Acceptable Use
Your use of the Service is also governed by our Acceptable Use Policy, which is incorporated into these Terms by reference. Violations may result in immediate suspension or termination of your account.
6. Safety
Rail facilities are dangerous. By using the Service you acknowledge and agree to our Safety Disclaimer, including but not limited to: stay on public property, never trespass, obey all crossing signals and law-enforcement direction, and do not rely on the Service for safety-critical decisions.
7. AI-Generated Content and Moderation
The Service uses automated systems (large language models, image and text classifiers, transcription) to clean up user submissions, summarize railfan spots, plan trips, moderate uploads, and detect trains in camera feeds. AI output may contain inaccuracies and is provided “as is.” You are responsible for reviewing AI-cleaned content before confirming submission. We may refuse, remove, or reject any User Content flagged by our automated moderation systems or by human review.
8. Subscriptions and Billing
Certain features (collectively, “Pro”) require a paid subscription. Subscriptions are billed in advance on a recurring basis through Stripe, Inc. Cancelling stops future renewals but does not refund the current billing period. Prices and feature gates may change on reasonable notice. Taxes are your responsibility where applicable.
9. Third-Party Data and Services
Train positions, schedules, and service alerts come from public GTFS feeds, official operator APIs, and third-party aggregators. We do not control these sources and make no warranty about their accuracy, timeliness, or availability. Railfan spot, station, and crossing data may be derived from OpenStreetMap and other open datasets subject to their own licenses.
10. Intellectual Property
The Service, including software, design, branding, and aggregated data layouts, is owned by Dynamanic LLC and protected by intellectual property laws. Except for the rights expressly granted to you in these Terms, no other rights are transferred.
11. Termination
You may delete your account at any time. We may suspend or terminate your access at any time, with or without notice, for any reason, including breach of these Terms. On termination, the licenses you granted to User Content survive only to the extent necessary to operate the Service for other users (for example, your past public sightings remain visible to the audience that already saw them).
12. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or accurate.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DYNAMANIC LLC AND ITS OWNERS, AGENTS, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) US$50.
14. Indemnity
You agree to indemnify and hold harmless Dynamanic LLC against any claims arising out of (a) your use of the Service, (b) your User Content, or (c) your violation of these Terms or any applicable law.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service will be resolved in the state or federal courts located in Seminole County, Florida, and you consent to personal jurisdiction in those courts.
16. Changes to These Terms
We may update these Terms from time to time. Material changes will be announced via the Service or by email to the address on your account at least 14 days before taking effect. Continued use of the Service after an update constitutes acceptance of the revised Terms.
